Laby — the label maker for tiny printers

1. Who you are agreeing with
These Terms of Use (“Terms”) form a binding agreement between you and:

referred to below as “we”, “us” or “Fasky”.
They govern your use of the Laby mobile app for iOS and Android, the Laby Pro subscription, the Ask Laby feature and the website at labykit.com (together, the “Service”). By downloading, installing or using Laby you accept these Terms. If you do not accept them, do not use the Service.
How we handle personal data is described separately in our Privacy Policy, which forms part of this agreement.
2. Who may use Laby
You may use Laby if you have the legal capacity to enter into a contract. If you are under 18, you may use Laby only with the consent of a parent or guardian, who accepts these Terms on your behalf. Laby is not directed to children under 14.
Using Laby requires a device running a supported version of iOS or Android and, for purchases, an Apple or Google account in good standing. Buying a subscription additionally requires that you are of the age of majority in your country, or have your guardian’s consent.
3. Your licence to use Laby
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Laby on devices you own or control, for your own purposes — private or commercial. Printing labels for your business, your shop, your parcels or your products is expressly permitted.
You may not:
- copy, distribute, sell, sublicense, rent or lend the app;
- reverse engineer, decompile or disassemble it, except to the extent this is expressly permitted by mandatory law (in Austria, §40e UrhG for interoperability);
- remove or obscure any copyright, trademark or attribution notice;
- circumvent, disable or interfere with any security, metering or usage-limit mechanism, including the Ask Laby allowance;
- use automated means to access the Service, or send it requests at a volume or rate that impairs it for others;
- use the Service to build a competing product, or to train a machine-learning model on our outputs, templates or interfaces.
Everything in the app that is not your own content — the software, the Laby character, the icon set, the built-in templates, the design and the name “Laby” — remains our intellectual property or that of our licensors. The built-in templates may be used to make and print your own labels, including commercially; they may not be extracted, redistributed or resold as artwork, template packs or assets.
4. Your content
Your labels, the text you write, the photos you place and the drawings you make are yours. We claim no ownership of them, and — as described in the Privacy Policy — they are stored on your device, not on our servers.
You are responsible for what you put on a label. You confirm that you hold the necessary rights to every image, logo, trademark, barcode and piece of text you use, and that printing it does not infringe anyone else’s rights.
When you use Ask Laby, you grant us a limited, worldwide, royalty-free licence to transmit and process the prompt and the label content described in the Privacy Policy — solely to produce the layout you asked for, to screen it for prohibited content, and to operate and protect the Service. That licence ends when the request ends. We do not use your content to train models, and we do not use it for advertising.
5. What you may not print
Laby drives a physical printer, so this section is not boilerplate. You may not use the Service to create, print or distribute:
- Counterfeit or deceptive product labelling — labels imitating a brand you do not own, forged authenticity or certification marks, or barcodes and GS1 identifiers you are not authorised to use;
- Forged official documents or markings — seals, tax stamps, tamper-evident or security labels, government or regulatory markings, or anything designed to pass as officially issued;
- False or unlawful regulated labelling — misrepresented ingredient, allergen, nutrition, expiry, pharmaceutical, dosage, hazardous-material, or safety information, or any labelling that breaches the food, medicines, chemicals or product-safety rules that apply to you;
- Content that infringes intellectual property, or that is unlawful, defamatory, harassing, hateful, or sexual content involving minors;
- Anything that would place another person’s personal data on a label without a lawful basis for doing so.
You are solely responsible for legal compliance of what you print. Regulated labelling — food, medicines, cosmetics, chemicals, electrical goods, shipping of dangerous goods — carries requirements that no app can verify for you.
We may refuse, limit or terminate access where we have reasonable grounds to believe this section is being breached.
6. Ask Laby and AI-generated content
Ask Laby turns a written description into a label layout using third-party AI models.
It is a drafting aid, not an authority. Generated layouts and text can be inaccurate, incomplete, oddly worded or simply wrong, and the same prompt may produce a different result each time. You must review every generated label before printing it, and you must not rely on generated content for any information that has to be correct — ingredients, allergens, dosages, expiry dates, hazard warnings, legal notices, prices or regulated markings. We give no warranty that generated output is accurate, fit for a particular purpose, unique to you, or free of third-party rights.
To the extent that rights in a generated layout can be held and are transferable, they are yours, subject to your compliance with these Terms. Be aware that AI output may closely resemble output produced for other users, and that its legal protectability differs by country.
Prompts are screened. Requests that our content check flags are refused and do not consume an ask. Refusals are automated and imperfect in both directions. Repeatedly attempting to obtain prohibited content may result in the feature or your access being suspended.
Report a problem. If Ask Laby produces something harmful, infringing or otherwise objectionable, use “Report AI content” in Settings or write to hello@labykit.com. We review reports and may adjust the feature’s safeguards.
We may change the underlying model, provider, prompts or limits at any time to improve quality, safety or cost. This may change the character of the results.
7. Laby Pro, billing and the monthly ask allowance
What Pro includes. Laby Pro unlocks every premium template and the Ask Laby feature, including 100 asks per month.
How the allowance works. One successful ask consumes one ask from your monthly balance. The allowance refreshes each subscription month; unused asks do not carry over, have no cash value and cannot be exchanged or refunded. If a request fails for a technical reason, is cancelled, times out, or is refused by the content check, that ask is not charged — and is returned to your balance if it had already been deducted. We may adjust the included quantity for future subscription periods; if we reduce it materially, we will tell you before it takes effect and you may cancel.
Purchase and payment. Subscriptions are sold and billed by Apple (App Store) or Google (Google Play), not by us. The price, currency and billing period shown at the point of purchase apply, including any taxes. We never receive your payment details.
Auto-renewal. Subscriptions renew automatically for the same period at the then-current price unless cancelled at least 24 hours before the end of the current period. Your store account is charged within 24 hours before renewal.
Free trial. Where a free trial is offered, it converts into a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends. Any unused portion of a trial is forfeited when you buy a subscription.
Managing and cancelling. Manage or cancel your subscription in your Apple or Google account settings — not in Laby. Cancelling stops the next renewal; it does not end the period you have already paid for, and Pro features stay available until that period expires.
Refunds are handled by Apple or Google under their own policies, since they are the seller of record. We cannot issue refunds for store purchases. Requests to Apple: https://reportaproblem.apple.com. Requests to Google: https://play.google.com/store/account.
Restore purchase. “Restore purchase” in the app asks the store whether your current store account already owns a subscription. A subscription belongs to a store account, not to a device.
Right of withdrawal (EU/EEA consumers). As a consumer you generally have 14 days to withdraw from a distance contract. For digital content and services supplied immediately, that right lapses once supply has begun with your express prior consent and your acknowledgement that you thereby lose the right of withdrawal (§18(1)(11) FAGG) — which is what happens when you start using Pro features straight away. Because Apple and Google are the sellers, exercise any withdrawal right with them.
8. Printers, hardware and consumables
Laby works with third-party Bluetooth thermal label printers. We do not make, sell, endorse or warrant any printer, and we are not affiliated with any printer manufacturer. Brand and model names are used descriptively to identify compatible hardware; all trademarks belong to their owners.
Compatibility is determined by reverse-engineered and publicly documented protocols and is offered on a best-effort basis. A printer may behave differently after a firmware update, and support for a given model may change or end.
Some printers verify their consumables (for example by RFID) and refuse third-party or depleted media. That behaviour lives in the printer’s firmware; Laby reports what the printer says but cannot and does not attempt to bypass it.
You use your printer at your own risk, in line with its manufacturer’s instructions. We are not responsible for wasted label stock, misprints, mechanical damage, or the interaction of any consumable with any device.
9. Availability and changes to the Service
We aim to keep Laby working but do not guarantee uninterrupted availability. Features may be added, changed, limited or removed, and server-side components (including Ask Laby) may be suspended for maintenance, or discontinued. The core label editor works offline; Ask Laby needs a working internet connection and our server to be reachable.
If we discontinue a paid feature entirely during a period you have paid for, you may cancel and seek a proportionate refund through the store that sold you the subscription.
10. Third-party services
Laby relies on services operated by others — Apple, Google, RevenueCat, Cloudflare and the AI providers listed in the Privacy Policy — and links to external pages such as the feedback form and the app store listings. Your use of those services is governed by their terms and privacy policies, and we are not responsible for their content, availability or practices.
11. Termination
You may stop using Laby at any time by deleting it; that also deletes the labels stored in it. Cancelling a subscription is done in your store account.
We may suspend or terminate your access, immediately and without refund, if you materially breach these Terms — in particular §5 (what you may not print) or §3 (circumventing the metering) — or where required by law. Sections 4, 5, 12, 13, 14, 15 and 16 survive termination.
12. Warranties and statutory rights
The Service is provided “as is” and “as available”. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that the Service will be error-free, that any label will print correctly on any given printer, or that AI output will be accurate or suitable.
Nothing in this section limits the statutory warranty rights (Gewährleistung) that you have as a consumer under Austrian and EU law, or any other mandatory consumer rights. Where those rights apply, they apply in full.
13. Limitation of liability
We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and under the Austrian Product Liability Act (Produkthaftungsgesetz).
For slight negligence, we are liable only for breach of an obligation essential to the purpose of this agreement, and then only for damage that is typical and foreseeable for this kind of contract. Any further liability for slight negligence is excluded — in particular for lost profit, lost or corrupted data, wasted label stock, printer damage, or losses arising from labels that were printed with incorrect content.
Because Laby stores your labels only on your device, you are responsible for keeping your own copies of anything you cannot afford to lose.
These limits do not affect mandatory statutory liability.
14. Indemnity (business users)
If you use Laby other than as a consumer, you will indemnify us against third-party claims, and reasonable legal costs, arising from labels you created or printed, from content you supplied, or from your breach of these Terms.
15. Apple and Google
The following applies to the version of Laby you obtained from the Apple App Store, and is included because Apple requires it:
- This agreement is concluded between you and Fasky e.U. only, not with Apple. Apple is not responsible for Laby or its content.
- Apple has no obligation to provide maintenance or support for Laby.
- If Laby fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Laby.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to Laby — including product liability claims, any claim that Laby fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation.
- We, not Apple, are responsible for the investigation, defence, settlement and discharge of any third-party intellectual property infringement claim relating to Laby.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
For the Google Play version, Google Play’s Terms of Service apply to the distribution and billing of the app in addition to these Terms.
16. Governing law and jurisdiction
These Terms are governed by the law of Austria, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer: this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country in which you habitually reside. You may bring proceedings against us in Austria or in the courts of your country of residence, and we may sue you only in the courts of the place where you are domiciled, habitually resident or employed (§14 KSchG, Art. 17–19 Brussels Ia Regulation).
If you are an entrepreneur (Unternehmer) within the meaning of the Austrian Consumer Protection Act: the exclusive place of jurisdiction for all disputes arising from or in connection with this agreement is Graz, Austria.
Consumer dispute resolution. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Consumers in Austria may nevertheless turn to the Internet Ombudsstelle (https://www.ombudsstelle.at) as a free alternative dispute resolution body. (The European Commission’s ODR platform ceased operation on 20 July 2025.)
17. Changes to these Terms
We may amend these Terms where necessary — for example to reflect new features, changed third-party services, or legal requirements. We will post the updated version here with a new “Last updated” date and, for material changes, notify you in the app before they take effect. If you do not accept a change, your remedy is to stop using the Service and cancel any subscription before the change takes effect. Changes never apply retroactively.
18. Miscellaneous
If any provision of these Terms is or becomes invalid, the remainder stays in force, and the invalid provision is replaced by the valid one that comes closest to its economic purpose. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these Terms without our consent; we may assign them to a successor of our business, provided your rights are not diminished.
These Terms, together with the Privacy Policy and the store terms that apply to your purchase, constitute the entire agreement between us concerning the Service.
